Deep Dive – State Leave and Pay Programs

Additionally, Vermont offers a pay law known as Vermont Family and Medical Leave Insurance (VT FMLI), which provides customizable plans for income replacement to employees of private employers who have opted into the program. Individual employees will be able to enroll themselves by July 1, 2025, if their employer has not enrolled already.
Where an employee is eligible for each law, VPFLA may run concurrently with federal FMLA and VT FMLI, if employees/employers opt in to the VT FMLI program. However, in relation to taking medical leave for one’s own condition, or a condition of a family member, federal FMLA generally defines a serious health condition as an illness, injury, impairment, or physical or mental condition that involves inpatient care or continuing treatment by a health care provider. Whereas VPFLA defines a serious health condition as a condition which “poses imminent danger of death, requires inpatient care in a hospital; or requires continuing in-home care under the direction of a physician”. In short, there could be situations in which an employee could qualify for federal FMLA and VT FMLI, for example, but not VPFLA depending on the seriousness of their/their family member’s medical condition.

Employer Notice Requirements
Some leave laws require that you notify your employees about their rights under the law, such as, by providing a prescribed notice to new hires, displaying a poster in the workplace, and/or including information about that leave law in your company handbook. Below you will find a summary of the requirements for each law.
Where the law requires that a leave poster/notice must be provided to the employee when they request leave, The Larkin Company will provide the applicable document within our introductory leave packets (see “Larkin Enclosures” within this resource).
Employer Statements Process (State Income Replacement Benefits)
Employers may be required to complete employer forms (as part of an employee’s claim for benefits) for certain state income replacement programs, so they must be prepared to look up employee information and respond within the given timelines. The Hartford will support employers who choose to offer VT FMLI to its employees with materials, forms, and tools, one of which may be an employer statement.
